In April 2025, U.S. Citizenship and Immigration Services (USCIS) released a revised Form I-9, Employment Eligibility Verification, with an edition date of 01/20/25. This update introduces several changes aimed at aligning with statutory language and enhancing clarity for both employers and employees.​

Key Changes in the 2025 Form I-9

Terminology Update in Section 1

The fourth checkbox in Section 1 has been renamed from “A noncitizen authorized to work” to “An alien authorized to work” to align with statutory language. Employers should note that while the form reflects this change, E-Verify cases will display "An alien authorized to work," even if the employee selected "A noncitizen authorized to work" on the form. ​USCIS

Revised Descriptions in List B Documents

Descriptions of two List B documents in the Lists of Acceptable Documents have been updated to provide clearer guidance on acceptable forms of identification.

Updated DHS Privacy Notice

The Department of Homeland Security (DHS) Privacy Notice has been revised to reflect current policies and practices regarding the collection and use of personal information. ​

Compliance Deadlines and Considerations
  • Form Usage: Employers may continue to use the 08/01/23 edition of Form I-9 until its expiration date of 05/31/2027. ​

  • Electronic Systems Update: Employers using electronic versions of Form I-9 must update their systems with the version that has the expiration date of 05/31/2027 by July 31, 2026. ​

  • Remote Document Examination: Employers enrolled in E-Verify and in good standing may continue to examine Form I-9 documents remotely, provided they follow the alternative procedure outlined by USCIS. ​
